GENERAL TERMS AND CONDITIONS OF SALE

ARTICLE 1 – Seller’s details

Hereinafter referred to as the “Seller”.

ARTICLE 2 – Scope of application

These General Terms and Conditions of Sale (the “GTCS”) apply, without restriction or reservation, to all sales concluded by the Seller with non‑professional buyers (“Customers”) wishing to purchase the products offered for sale on the website https://www.cleverfaces.com (the “Website”).

The products offered are personalised books intended for family or educational use, incorporating portraits generated using artificial intelligence based on images provided by the Customer.

Each clause of these GTCS is independent. The invalidity of any provision shall not affect the validity of the remaining provisions.

Products are offered for sale in the geographical areas indicated on the Website. In the event of an order to a country other than mainland France, the Customer is deemed to be the importer of the product. Any customs duties or local taxes that may be payable shall remain the sole responsibility of the Customer.

Visuals presented on the Website are provided for illustrative purposes only and have no contractual value. Customers are required to refer to the product descriptions for precise characteristics.

Before placing an order, the Customer acknowledges having read and accepted these GTCS without reservation.

ARTICLE 3 – Ordering process

The Customer selects a product, chooses the language of the book, enters the name and gender of the character, writes a dedication, and uploads the images required for personalisation. The Customer accepts the GTCS, validates the shopping cart, provides contact details, selects a delivery method and proceeds with payment.

Once payment has been validated, a preview of the book is made available to the Customer. The Customer must select the final portraits and confirm the personalised elements. Final validation corresponds to the Customer’s explicit confirmation of all personalised elements (images, text and final choices) and triggers production.

From the moment of final validation, the order is considered firm and final and is sent to print.

If the Customer fails to select the images within ten (10) days of the preview being made available, and after an email reminder, the Seller reserves the right to finalise the portrait selection in order to proceed with production.

Product offers are subject to availability.

ARTICLE 3 bis – Use of images and persons depicted

As part of the personalisation process, the Customer may upload photographs depicting adults or minors.

By uploading images to the Website, the Customer declares and warrants that they are the parent or legal guardian of the minor depicted, or that they have obtained the express and prior authorisation of the parent or legal guardian, or of the person concerned where they are an adult.

The Customer warrants that they hold all rights necessary to use the images provided and that such images do not infringe the rights of any third party.

The Seller does not verify the identity or parental authority of the Customer and relies solely on the Customer’s declarations. The Customer agrees to indemnify the Seller against any claim or action arising from the use of the uploaded images.

Images must not contain any unlawful, violent, pornographic or offensive content and must comply with the technical guidelines provided by the Seller.

ARTICLE 3 ter – AI‑generated portraits

Portraits featured in the books are generated using artificial intelligence technologies based on the images provided by the Customer.

The Customer acknowledges that the generated portraits constitute artistic interpretations and that the final result depends directly on the quality, consistency and compliance of the source images with the provided guidelines.

While perfect resemblance cannot be guaranteed, the Seller is committed to customer satisfaction. Where a Customer is not satisfied with the portrait result, the Seller will first offer one (1) additional generation upon submission of new images. If the Customer remains unsatisfied following this second attempt, the Seller will issue a full refund upon request.

ARTICLE 3 quater – Customer inactivity

After the book preview has been made available and the Customer has been requested to take action, the project shall remain active for a maximum period of thirty (30) calendar days from the date of the last request. Reminder notices shall be deemed validly delivered when sent to the email address provided by the Customer at the time of ordering.

In the absence of a response within this timeframe, despite several reminders, the Seller may close the project. In such cases, the Customer will be issued a full refund to the original payment method, or may choose to receive a credit note or gift card of equivalent value valid for twelve (12) months on the Website.

The Seller will make every reasonable effort to contact the Customer before closing the project.

ARTICLE 4 – Prices

Prices are stated in euros, inclusive or exclusive of taxes depending on the destination, and exclusive of delivery costs. The prices applicable are those in force at the time the order is validated.

An invoice is automatically sent to the Customer by email.

ARTICLE 5 – Payment terms

Payment is due in full at the time of ordering and is made by credit card via a secure payment solution. Payment data is encrypted in accordance with applicable security standards.

The order shall be deemed final only once payment has been effectively received.

ARTICLE 6 – Delivery

Delivery times indicated on the Website are provided for information purposes only and commence upon final validation of the project by the Customer.

Delivery times may be extended in particular in the event of delayed Customer validation, peak activity periods, or technical or logistical constraints.

The Seller reserves the right to temporarily suspend delivery to certain geographical areas.

In the event of excessive delay not attributable to the Customer, the Customer retains the rights provided for under Articles L.216‑1 et seq. of the French Consumer Code.

ARTICLE 7 – Right of withdrawal

In accordance with Article L.221‑28 (3°) of the French Consumer Code, the right of withdrawal does not apply to goods made to the Customer’s specifications or clearly personalised, in particular where personalisation involves the use of images supplied by the Customer.

Notwithstanding the above, the Seller offers a voluntary satisfaction guarantee: customers who remain unsatisfied after the portrait review and regeneration process may request a full refund by contacting contact@cleverfaces.com.

ARTICLE 8 – Statutory warranties

Products benefit from the statutory warranty of conformity and the warranty against hidden defects in accordance with applicable law.

ARTICLE 9 – Force majeure

The Seller shall not be held liable in the event of force majeure as defined by French law and case law. Force majeure events include, but are not limited to, major technical failures, digital service interruptions or the unavailability of essential technical service providers.

ARTICLE 10 – Intellectual property

All content on the Website is protected by intellectual property law. Any reproduction without authorisation is strictly prohibited.

ARTICLE 10 bis – Personal data

The Seller acts as data controller within the meaning of Regulation (EU) 2016/679 (GDPR) for personal data collected in connection with orders.

Personal data and images provided by the Customer are processed solely for the purposes of order management and production of personalised books, in accordance with the Privacy Policy available on the Website.

Data processing may involve technical service providers acting on behalf of the Seller and subject to confidentiality and security obligations compliant with GDPR.

Uploaded images and generated models are retained for a maximum period of sixty (60) days following completion of the order or the last interaction with the Customer, after which they are deleted unless a legal obligation requires otherwise.

No image or generated portrait is reused without the Customer’s prior written consent.

ARTICLE 11 – Governing law

These GTCS are governed by French law. In the event of translation, the French version shall prevail.

ARTICLE 12 – Disputes and mediation

In the event of a dispute, the Customer may have recourse free of charge to the CM2C consumer mediation service:
